This document from the European Commission (EC) focuses on the Anti-Contraband and Anti-Counterfeit Agreement signed between Philip Morris International, the European Union (EU) and its Member States on July 9, 2004. This “PMI Agreement” aimed at reducing the illicit trade in PMI contraband. As it expired on July 9, 2016, this document analyses its performance.
According to the EC, the PMI Agreement met its objective of decreasing the presence of PMI contraband on the illicit EU marketplace. However, it does not result in an overall reduction of the illicit trade in tobacco products.
The document also underlines that the legislative framework and the illicit tobacco market have evolved since the entry into force of the Agreement. For instance, since 2014, there is a new Tobacco Product Directive (TPD) and, the global WHO Framework Convention on Tobacco Control’s Protocol to Eliminate Illicit Trade in Tobacco Products (FCTC Protocol) is undergoing the ratification process in the EU.
